Re: Annual Notice of General Monitoring of Electronic Data
 

Dear Parents:
 
Recently passed legislation requires school districts to provide an annual notice to parents in any school year when it will generally monitor or electronically access school-issued devices.  “School-issued devices” means hardware, software, devices, and accounts that the school district, acting independently or with a Technology Provider, provides to an individual student for the student’s dedicated personal use.  
 
As is standard practice at school districts across the state, Fairview Park City School District (“District”) will monitor and/or access electronic data on school-issued devices for this school year, either directly or through a technology provider.  
 
Pursuant to the law, the District will not electronically access or monitor any of the following on a school-issued device unless one of the exceptions set forth below applies: location-tracking features; audio or visual receiving, transmitting, or recording features; and student interactions with a school-issued device, including, but not limited to, keystrokes and web-browsing activity contained on a school-issued device.
 
Monitoring will occur for the following:
 

  1. The activity is limited to a noncommercial educational purpose for instruction, technical support, or exam-proctoring by District employees, student teachers, staff contracted by the District, a vendor, or the Ohio Department of Education and Workforce;
  2. The activity is permitted by a judicial warrant;
  3. The District or Technology Provider is notified or becomes aware that the device is missing or stolen;
  4. The activity is necessary to comply with federal or state law;
  5. The activity is necessary to participate in federal or state funding programs; or
  6. The activity is necessary to prevent or respond to a threat to life or safety, and the access is limited to that purpose.
